Antispam Policy

The company firmly opposes the distribution of spam.

CAN-SPAM Act is a law that sets the rules and requirements for the mailing of electronic messages, and provides the users with the right to stop such messages and to use harsh penalties for violations of these rules.

The Site Administration takes seriously sending of targeted e-mails only. Creating an account and agreeing with the Terms of Use, the User shall also comply with the Anti-Spam Policy. The Administration provides the infrastructure for sending only targeted e-mails from the Users, companies and organizations to their subscribers, and (or) recipients who agree to receive messages.

The Site Administration is strongly opposed to the distribution of undesirable e-mails. In accordance with the Terms of Use, deliberately, the Administration doesn’t allow using the Site to distribute spam or unsolicited commercial emails (UCE). The Administration prohibits the use of the software on the e-mail marketing by those users and businesses that send or plan to send SPAM (UCE).

If it is determined that the User distributes and sends spam using the infrastructure of the Site, the User’s Account will be blocked immediately, the provision of services will be terminated and the User will be sent a claim. If you know or suspect such violators, please, immediately notify the Site Administration or fill in the form “Report on spam”.

The Administration does not control or limit the User to create e-mail messages. However, the Administration quickly and seriously responds to notices of violations or abuses of the terms of service. As a rule, the decision on eligibility will be made within 48 hours.

In addition, the Site Administration does not own, buy or sell databases for mailings and does not approve the use of acquired, leased, or collected from the Internet data with the help of specially designed software.

Legal requirements

The Site Administration requires all Users to comply with the legal requirements of applicable law of the country of residence relating to spam, commercial e-mails and collection and protection of personal data. These legal requirements include:

  • CAN-SPAM Act of 2003 (Act on control of the spread of prohibited pornography and marketing),
  • E-commerce Directive (2000/31/EC) of the European Parliament and the Council dated June 8, 2000 on the legal aspects of information society services, in particular, electronic commerce in the domestic market, and
  • Directive on Privacy of Electronic Communications (2002/58/EC) of the European Parliament and the Council dated July 12, 2002 on the processing of personal data and privacy protection in electronic communications sector.

SPAM definition

Personal identity of the recipient and the context are irrelevant because the message is equally applicable to many other potential recipients of the message. Spam is any e-mail, as well as a private message, sent to the Recipient who did not provide the Sender a direct intentional, explicit, or any authorization to contact him concerning the email subject. Spam is also a message, the subject and the text of which contain false, incorrect or misleading information. Transmission and receipt of the message by the recipient is considered disproportionately in favor of the sender.

Mandatory Unsubscribe Parameters

Each message sent by the Site contains a link to unsubscribe, which is mandatory for each message. The functionality of “Unsubscribe” from the mailing may require the recipient:

  • to fill out a special form (to enter the email address in the field to which the recipient does not wish to receive messages) and send the request to unsubscribe (hivens.com/about/antispam);
  • to log into the account, and disable the subscription through the subscription (notification) management page, if the User is registered on the Site.

What addresses can be used for mailings?

By registering on the Site, the User agrees to receive e-mails from the Administration of the Site, as well as an opportunity to manage mailings in the Settings of the Account.

The User pressing the “Find Friends” or “Invite friends” button of the mail services and social networks, confirms that he has the consent of the Addressee to receive the e-mail sent via the Site, and allows the Site to copy the email addresses of friends from the address book of the email or contacts in a social network to send them an email invitation or notice. Contact information of the friends of the User shall be deposited in the Account section and will not be shared with the third parties.

Also, the Administration of the Site and the Site Users have the right to send messages to the emails for which they have obtained explicit consent from the owners:

  • Through a subscription form on the Site or e-mail mailing;
  • Your personal e-mail correspondence with the client contains an active link to the subscription web form;
  • Other options for permission to use the contacts on the Site may not be sufficient.

Report on SPAM

If the Recipient suspects that he received an unsolicited email, Spam from another User of the Site, the Recipient can forward the original received e-mail, with the following information:

  • Complete information on the subject of the email and the sender's name and / or email address;
  • E-mail address to which the suspected Spam was received (Note: the address may differ from the one to which you send us a complaint);
  • Date and time of the receipt of the electronic message.

The Administration carefully reviews and investigates all complaints about Spam. Finding the affected e-mail addressed, the Administration will as promptly as possible remove them from the corresponding mailing list(s) of the Site or the User.
